Family therapists and family court judges encourage divorced parents to maintain the existing schedule as much as possible. In some instances, however, petitioning for a modification is reasonable. The child should not be put in a situation of increased risk, especially if he or she has an underlying health problem.

The U.S. Centers for Disease Control has provided a list of conditions that could increase a child's risk of more serious symptoms. Nearly all of the disorders and illnesses also are risk factors for adults. Some are known and others are suspected.

Examples of known risks include obesity, cancer, Type 2 diabetes, sickle cell disease, and chronic kidney disease. Examples of potential risk factors include asthma, cystic fibrosis, Type 1 diabetes, and a weakened immune system. The reason researchers are still unclear about all of these threats is that COVID-19 is such a new disease. Scientists are working diligently to learn more about the novel coronavirus that causes COVID-19.

An example of a high-risk situation would be one parent's significant other working in an emergency room or as an emergency medical technician. Another is when someone else in the household ignores social distancing guidelines, raising the chance of infection. If this person routinely goes into bars and restaurants and spends time there, a temporary modification in Child custody may be reasonable.

Child visitation rights are court-ordered, and one parent cannot arbitrarily make decisions if the other disagrees. A family court judge expects any modification to include ways to make up for the time lost between one parent and the child. Perhaps family law child custody could be scheduled twice a week, for example. The parent may be granted extra time with the youngster when the healthcare crisis has finally passed.

An exception to these parameters would be when a mother or father sees the need to file for Emergency child custody. The child faces a higher risk of COVID-19 infection because of the other parent's behavior. There might be frequent guests in close contact at the home during the pandemic, for example. The parent may be bringing the child to a babysitter with numerous other youngsters present.
